Default Partial-birth Abortion Ban Upheld by U.S. Supreme Court!

Today the U.S. Supreme Court upheld the Federal ban against partial-birth abortion as a procedure, with Catholic senior Associate Justice Kennedy writing the majority opinion and concurred in by the other 4 Catholic justices: Chief Justice John Roberts and Associate Justices Antonin Scalia, Clarence Thomas, and Samuel Alito! ! !

The review of the historical Roe v. Wade (1973) is still far away, perhaps, but this bodes well for those in the pro-life trenches fighting for the "culture of life" that the Catholic Church has espoused for time immemorial. In this decision, the "sanctity of life" came to the fore!

Thanks be to God for the 5 Catholic Justices of the U.S. Supreme Court in deciding the twin cases appealed by certiorari, which is based on a clear Catholic understanding of the value of life.

Let us not forget that partial birth abortion can still be done provided the doctor can prove that the pregnancy will cause a threat to the mother's life. We are not out of the woods yet.

This proceedure is barbaric and inhuman but there are those who will be able to for whatever reasons be able to still get this type of abortion and still remain within the guidelines of what the Supreme Court has just moved on.

And since Justice Kennedy who normally votes center, center left, cast the deciding vote on this ban there will be a tremendous effort on the part of the ACLU and women's organizations to get him to change his mind and vote the other way.

Out of clarification, partial birth abortion is when a child is killed as it is being born, correct? Or is that something else I am thinking of?

Sparing you most of the gross details, but the baby is pulled from the womb feet first leaving only the head in the mothers belly. Forcips are then used to severe the spinal column to the brain and the infant dies then the rest of the head can then be pulled free of the mother.

It is an absolutely horrendous crime against children.

I am very happy that they now have this (albeit somewhat limited) protection confirmed for them.

This is not true-thetre is no health of the Mother exception in this bill-the reason being the Court finally recognized the obvious-there is no circumstances under which this procedure is needed.

The overwhelming majority of Americans are in favor of banning partial-birth abortion. It was a bi-partisan measure that passed the legislature easily (notwithstanding the tempest in a teapot controversy the pro-death crowd raised). The true test was not its popularity (on which count it overwhelmingly succeeds), but it was in passing by the elitist intellectuals who picked it apart for any minor legal flaw they could find. Surprinsingly (thanks be to God!), 5 out of 9 did not find it and upheld the law.

Actually, it can still done all long as the fetus is killed by injection prior to the D&E. From the decision:

Not surprising that Obama said this - he's a long-time supporter of all forms of abortion. And of course, on the news I just saw that wonderful Catholic politician, Nancy Pelosi, bemoaning the ruling. Does this woman have any decency at all? I cannot imagine how anyone could support this type of "procedure" - what a clean name for murder.
