So the “death penalty” of abortion may constitute “cruel and unusual punishment”?

Since the article mentioning the developing sense of touch at about 10 weeks, those who advocate 1st trimester abortion may believe they have an “out”, but evidence of fetal pain during abortion may at least make more people stop and think about what they are doing.

The argument of “cruel and unusual” just might work, but only if the unborn are given HUMAN status.
